Rules of the “Letter to Santa from a Professional” competition

§ 1. Definitions

1. “Competition” – the competition entitled “A Letter to Santa from a Professional”, conducted in accordance with the rules set out in the Terms and Conditions,
2. “Organiser” – “Polbruk ” S.A., with its registered office in Gdańsk, ul. Nowy Świat 16 c, 80-299, a company entered in the National Register of Entrepreneurs maintained by the District Court in Gdańsk, 12th Commercial Division of the National Court Register, under KRS number: 0000062419, share capital: PLN 31,766,250.00, with REGON number: 001388727 and NIP number: 5840253591
3. “Participant” – a natural person residing in the territory of the Republic of Poland, having full legal capacity, or a natural person who has reached the age of 18.

§ 2. General

provisions 1. The Competition is in no way connected with, sponsored by, endorsed by or organised by Facebook.com. Facebook.com is a registered trademark of Facebook Inc. The information provided by a person entering the Competition is made available to the Organiser, not to Facebook.com. This information will be used solely for the purpose of conducting the Competition.
2. Participation in the Competition is voluntary and free of charge.

§ 3. Conditions of participation in the competition

1. The competition will run from 4 December 2020 (from 12:00) to 8 December 2020 (until 23:59). The results will be announced by 10 December 2020 at 16:00.
2. The conditions for participation in the competition are:
a) reading and accepting these Rules and Regulations,
b) completing the competition task, which involves posting a response under the competition post: ‘Expert – write a letter to Father Christmas and describe what you dream of in your professional life’. Remember – the more creative your description, the better your chances of winning!

§ 4. Rules and outcome of the Competition

1. The Competition Committee, consisting of 3 members appointed by the Organiser, shall oversee the proper conduct of the Competition. The committee’s tasks include overseeing the proper conduct of the Competition, selecting the winners, announcing the results, and considering complaints submitted by Participants.
2. The competition task involves posting a response under the competition post: Expert – write a letter to Father Christmas and describe what you dream of in your professional life. Remember – the more creative your description, the better your chances of winning!
3. The deadline for posting entries under the competition post is 8 December 2020 at 23:59. Entries posted after this deadline will not be entered into the Competition.
4. Employees of Polbruk (the Organiser) and employees of companies cooperating with the Organiser are not eligible to enter the competition.
5. The Organiser will select 3 winners who have posted the most interesting entries
6. The Competition Participant bears full liability towards the Organiser
in the event that third parties make claims against the Organiser for infringement of their rights resulting from the Organiser’s use of the response submitted by the Competition Participant.
7. Within one day of selecting the winner, the Organiser will notify them of their win via a comment under their competition entry on Facebook.com and will ask them to contact the Organiser via a private message to provide their contact details for the purpose of delivering the prize.
8. Entries that are deleted by Facebook administrators or rendered permanently inaccessible as a result of a breach of the site’s terms and conditions will not be considered in the Competition.

§ 5. Prizes and their distribution

1. The main prize in the Competition is a set of merchandise: 

- 1 desk calendar – PLN 20
each- 1 small wall calendar – PLN 6
each- 1 bottle of Dafi – PLN 25 each
- 1 navy blue ‘Polbruk ’ bag – PLN 2
each- 1 pencil – PLN 1
each- 1 ballpoint pen – PLN 2.50 each
- 1 multitool – PLN 25 each
- 1 soup mug – PLN 25 each
- 1 coffee mug – PLN 5.65 each
- 1 notebook – PLN 7.20 each

2. The Organiser will award the main prize to 3 winners. Each winner will receive one main prize, as specified in point 1 of this paragraph (one set of merchandise)
3. Within one week of receiving notification of their win, the winner is required to provide the Organiser with their contact details necessary for the prize to be issued, i.e. first name, surname, postal address and telephone number.
4. Prizes will be sent by courier or post within 20 working days of the Organiser receiving the winner’s details.
5. The Organiser shall not be liable for failure to deliver the prize if the Competition Participant fails to provide the contact details necessary for dispatch in the manner specified in the Rules, or provides incorrect or incomplete contact details.
6. If the winner fails to collect the prize or if the prize cannot be delivered due to the winner providing incorrect contact details, the prize shall remain the property of the Organiser.
7. The decision of the Competition Jury regarding the awarding of the prize is final and cannot be appealed.
8. Competition winners may not transfer the right to receive the prize to third parties.
9. In the event that, under generally applicable laws, the prize is subject to a flat-rate personal income tax, the Organiser shall be responsible for collecting the tax from the Competition Winner and paying it to the relevant tax office. The amount of personal income tax due shall be paid by the Organiser into the account of the relevant Tax Office.

§ 6. Procedure for submitting and considering complaints

1. Complaints may be submitted during the duration of the Competition, at the latest within 30 working days of the final date of the Competition’s conclusion. The above does not preclude the right to pursue claims under general principles. Complaints must be submitted in writing.
2. Complaints should be sent to the Organiser’s address:Polbruk S.A., ul. Nowy Świat 16 c,
80-299 Gdańsk, within 30 days of the end of the Competition (the date on which the Organiser receives the complaint shall apply). The complaint should include the details of the person making the complaint (i.e. first name, surname and postal address), the reason for the complaint and a request for specific action by the Organiser.
3. Complaints received will be considered by the Organiser within 7 working days of the date of receipt by the Organiser. The parties concerned will be informed of the outcome of the complaint by registered post.

§ 7. Processing of personal data

1. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as the “GDPR”), the Controller of the Participants’ personal data is Polbruk S.A., with its registered office in Gdańsk, at ul. .pl 2. Participants’ personal data is processed for purposes related to:
a. the organisation and conduct of the Competition, including the handling of complaints – on the basis of consent freely given by the Participant (Article 6(1)(a) of the GDPR),
b. tax settlement of prizes awarded in the Competition (Article 6(1)(c) of the GDPR),
c. establishing, pursuing or defending against any claims arising from the Competition – legitimate interests pursued by the controller (Article 6(1)(f) of the GDPR),
3. The recipients of personal data will be entities to whom the disclosure of Participants’ data is necessary to achieve the purposes of processing; in particular, these will be entities providing IT, accounting or legal services, as well as public bodies to whom the disclosure of Participants’ personal data by the Organiser constitutes a legal obligation arising from generally applicable laws.
4. The Organiser will retain Participants’ personal data for the period necessary until the expiry of the limitation period for public law obligations related to the Competition.
5. The Participant has the right to access and rectify their data, as well as the right to erasure, restriction of processing, objection to processing, data portability and the right to lodge a complaint with the President of the Office for Personal Data Protection.
6. The provision of data is voluntary and takes place on the basis of the Participant’s consent; however, failure to provide such data will prevent the Participant from taking part in the Competition.
7. The Participant may withdraw their consent to the processing of their data at any time without affecting the lawfulness of the processing carried out on the basis of consent prior to its withdrawal.

§ 8. Final

provisions 1. The Competition Rules are available online – on the Jestem Fachowcem Facebook page and at the Organiser’s premises.
2. By entering the Competition, the Participant is obliged to act in accordance
with the provisions of the Rules and the applicable laws.
3. In matters not covered by the Rules, the applicable laws shall apply.
