§ 1. Definitions
1. “Competition” – the competition entitled “Volleyball Champions League with Polbruk. ZAKSA-Verona 2021 Champions’
Jersey” conducted in accordance with the rules set out in the Terms and Conditions,
2. “Organiser” –Polbruk
S.A., with its registered office in Gdańsk, ul. Nowy Świat 16 c, 80-299, a company entered in the National Register of Entrepreneurs maintained by the District Court in Gdańsk, 12th Commercial Division of the National Court Register, under KRS number: 0000062419, share capital: PLN 31,766,250.00, with REGON number: 001388727 and NIP number: 5840253591
3. “Participant” – a natural person resident in the territory of the Republic of Poland, having full legal capacity, or a natural person who has reached the age of 18.
§ 2. General
provisions
1. The Competition is in no way connected with, sponsored by, endorsed by or organised by Facebook.com. Facebook.com is a registered trademark of Facebook Inc. Information provided by a person entering the Competition is made available to the Organiser, not to Facebook.com. This information will be used solely for the purpose of conducting the Competition.
2. Participation in the Competition is voluntary and free of charge.
§ 3. Conditions of participation in the competition
1. The competition will run from 28 April 2021 (from 12:00) until 10 May 2021 at 23:59. The results will be announced by 11 May 2021 at 16:00.
2. The conditions for participation in the Competition are:
a) reading and accepting these Rules,
b) completing the competition task, which involves posting a comment under the competition post. ZAKSA Kędzierzyn-Koźle will play in the World Champions League Super Final against @Itas Trentino. As a sponsor of ZAKSA, we have a special competition for you.
There are 5 shirts to be won, exactly like the ones our team will wear in the final!
All you have to do is write in the comments why you should be the one to receive it.
The authors of the 5 most creative answers will be awarded a final jersey.
§ 4. Competition
Rules and Results
1. The competition committee, consisting of 3 members appointed by the Organiser, shall oversee the proper conduct of the Competition. The committee’s tasks include overseeing the proper conduct of the Competition, selecting the winners, announcing the results, and considering complaints submitted by Participants.
2. The competition task involves posting a comment under the competition post explaining why you should receive a ZAKSA T-shirt.
3. The deadline for posting responses under the competition post is 10 May 2021 at 23:59. Entries posted after this deadline will not be entered into the Competition.
4. Employees of Polbruk
(the Organiser) and employees of companies cooperating with the Organiser are not eligible to enter the Competition.
5. The Organiser will select 5 winners of the competition who submit the most interesting entries
6. The Competition Participant bears full liability towards the Organiser
in the event that third parties make claims against the Organiser for infringement of their rights resulting from the Organiser’s use of the response submitted by the Competition Participant.
7. Within one day of selecting the winner, the Organiser will notify them of their win via a comment under their competition entry on Facebook.com and will ask them to contact the Organiser via a private message to provide their contact details for the purpose of delivering the prize.
8. Entries that are deleted by Facebook administrators or rendered permanently inaccessible as a result of a breach of the site’s terms and conditions will not be considered in the Competition.
§ 5. Prizes and their distribution
1. The main prize of the competition is 5 ZAKSA Kędzierzyn Koźle team shirts, which the team will wear in the World Champions League super final against Itas Trentino on 10 May 2021.
2. The unit value of the main prize is: PLN 100 gross.
3. The Organiser will present the prize to the 5 winners. Each winner will receive one prize, as specified in point 1 of this paragraph.
4. Within one week of receiving notification of their win, the winner is required to provide the Organiser with their contact details necessary for the prize to be issued, i.e. first name, surname, postal address and telephone number.
5. Prizes will be sent by courier or post within 20 working days of the Organiser receiving the winner’s details.
6. The Organiser shall not be liable for failure to deliver the prize if the Competition Participant fails to provide the contact details necessary for dispatch in the manner specified in the Rules, or provides incorrect or incomplete contact details.
7. If the winner fails to collect the Prize or if the Prize cannot be delivered due to the winner providing incorrect contact details, the Prize shall remain the property of the Organiser.
8. The decision of the Competition Jury regarding the award of the Prize is final and cannot be appealed.
9. Competition winners may not transfer the right to receive the prize to third parties.
10. In the event that, under generally applicable laws, the prize is subject to a flat-rate personal income tax, the Organiser shall be responsible for collecting the tax from the Competition Winner and paying it to the relevant tax office. The Organiser shall pay the amount of personal income tax due to the account of the relevant Tax Office.
§ 6. Procedure for submitting and considering complaints
1. Complaints may be submitted during the duration of the Competition, at the latest within 30 working days of the final date of the Competition’s conclusion. The above does not preclude the right to pursue claims under general principles. Complaints must be submitted in writing.
2. Complaints should be sent to the Organiser’s address:Polbruk
S.A., ul. Nowy Świat 16 c, 80-299 Gdańsk, within 30 days of the Competition’s closing date (the date on which the Organiser receives the complaint shall be decisive). The complaint should include the details of the person making the complaint (i.e. first name, surname and postal address), the reason for the complaint and a request for specific action by the Organiser.
3. Complaints received will be considered by the Organiser within 7 working days of the date of receipt by the Organiser. The parties concerned will be informed of the outcome of the complaint by registered post.
§ 7. Processing of personal data
1. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as the “GDPR”), the Controller of the Participants’ personal data is Polbruk

.pl 2. Participants’ personal data is processed for purposes related to:
a. the organisation and conduct of the Competition, including the handling of complaints – on the basis of consent freely given by the Participant (Article 6(1)(a) of the GDPR),
b. tax settlement of prizes awarded in the Competition (Article 6(1)(c) of the GDPR),
c. establishing, exercising or defending against any claims arising in connection with the Competition – legitimate interests pursued by the controller (Article 6(1)(f) of the GDPR),
3. The recipients of personal data will be entities to whom the disclosure of Participants’ data is necessary to achieve the purposes of processing; in particular, these will be entities providing IT, accounting or legal services, as well as public bodies to whom the disclosure of Participants’ personal data by the Organiser constitutes a legal obligation arising from generally applicable laws.
4. The Organiser will retain Participants’ personal data for the period necessary until the expiry of the limitation period for public law obligations related to the Competition.
5. The Participant has the right to access and rectify their data, as well as the right to erasure, restriction of processing, objection to processing, data portability and the right to lodge a complaint with the President of the Personal Data Protection Office.
6. The provision of data is voluntary and takes place on the basis of the Participant’s consent, but failure to provide such data will prevent the Participant from taking part in the Competition.
7. The Participant may withdraw their consent to the processing of their data at any time without affecting the lawfulness of the processing carried out on the basis of consent prior to its withdrawal.
§ 8. Final
provisions
1. The Competition Rules are available online at www.polbruk
.pl and at the Organiser’s registered office.
2. By entering the Competition, the Participant undertakes to act in accordance
with the provisions of the Rules and the applicable laws.
3. In matters not covered by the Rules, the applicable laws shall apply.
